III. Conclusions

The process of approximation of the environmental law of the Slovak Republic with EU law is proceeding relatively successfully. Previously the process was more spontaneous, but has now become systematic, especially after the authorization of the "White Paper."

The advantages which flow from the approximation process with EU law include:

complementation of environmental protection law with fields which traditionally were not included, or were in fact absent in these countries;
changes in technical issues and standards;
transition from the protection of individual parts of the environment to more complex environmental protection;
completion of the democratic elements of environmental protection.

The following aspects support the approximation process of environmental law with EU law in the Slovak Republic:

support of government to ensure this process;
accessibility of the EU legal regulations by the Ministry of the Environment (through the PHARE Program);
establishment of a special division for legal approximation as part of the legislation department of the Ministry of the Environment;
the reality that many basic principles have existed for a long time in Slovak environmental law.

Obstacles to the approximation process of Slovak laws with the EU law include:

absence of financial resources for translation of the EU regulations into Slovak;
divided responsibility between several ministries in some fields of environmental protection (for example chemicals, noise): this reality makes the approximation process more difficult;
parallel rebuilding of the legal system in general, which is a strain on human resources, especially lawyers.

As a general conclusion, we can say that Slovak environmental law is to a significant extent in harmony, or at least not in conflict with EU law. Now that the approximation process is becoming more systematic, we can expect it will continue successfully.
