  • Albania
    In November and December 2005 the team, replicating a successful methodology in the field of Chemicals, prepared a gap analysis of the Albanian Chemicals legislation against the EU chemicals acquis and presented its findings during a Workshop “Towards a Legal Framework on Chemicals in Albania harmonized with the EU acquis”, December 9, 2005 to discuss also key issues for the process of harmonization of the Albanian legislation with the EU acquis.

    In November 2005, following to the successful preparation of a draft law on Noise in Kosovo, Albania requested assistance in the same field and, with a meeting in Tirana in November, 2005 the experience in Kosovo was transferred to a wide range of stakeholders in order to create the foundations for the transposition of the Directive 2002/49/EC.

    The team reviewed the environmental protection law of September 2002 with respect to its compliance with EC principles and general legal requirements. The analysis found gaps that require legislative action and recommended further amendments toward full compliance with EU requirements.

  • Bosnia and Herzegovina
    The Workshop on Approximation of Nature Protection Acquis in Bosnia and Herzegovina took place in Sarajevo on December 20, 2005. Its objective were to present the EU legal framework on nature protection; to present and discuss the draft subsidiary regulations on nature protection prepared in the framework of the project; and to provide recommendations on the draft regulations and next steps towards a comprehensive legislative system on nature protection.

  • Croatia
    The Workshop on Approximation of the Environmental Liability Directive took place in Zagreb, Croatia, on November 21, 2005. Its objectives were to support the process of approximation to EU environmental acquis; provide an overview of the Directive on Environmental Liability with Regard to the Prevention and Remedying of Environmental Damage; foster a forum for discussion on steps towards approximation to the Environmental Liability Directive; and provide a set of clear recommendations for approximation to the Environmental Liability Directive.

    Comments on the waste law included recommendations for amendments in the form of a detailed table of concordance and a review of the consistency of and compliance with EU waste legislation.

  • Former Yugoslav Republic of Macedonia
    Following the workshop on EU chemicals in Skopje a team of international experts provided a legal review of the present chemicals legislation in the former Yugoslav Republic of Macedonia, including recommendations on the needed amendments and further drafting needs.
    An analysis of the article on eco-labelling from the latest version of a draft environmental protection law provided concrete amendments and suggestions to clear the way for adoption of needed subsidiary legislation and also to ensure compliance with pertinent EU requirements.

    The EU Chemicals Workshop took place on November 11-12, 2004 in Skopje, former Yugoslav Republic of Macedonia, and provided, for the first time in that country, an overview of the EU chemical regulation system. The Serbian officials involved in the drafting of the chemicals law attended the workshop, sharing experience from their recent work. Legal experts from the Republic of Montenegro, Serbia and Montenegro joined to learn from the experience of their colleagues. Slovenian and Bulgarian experience was offered, which was of great interest to the participants.

    The national workshop Opportunities for Developing an Eco-labelling System in former Yugoslav Republic of Macedonia Based on EU Legislative Framework, took place on July 4-15, 2003 in Skopje, former Yugoslav Republic of Macedonia. The workshop supported approximation to EU environmental legislation, provided a comprehensive overview of the European Integrated Product Policy and eco-labelling, was an opportunity for exchange of experience on eco-labelling schemes in EU member states and accession countries, fostered dialogue between stakeholders and strengthening their capacity with regard to the establishment of an eco-labelling scheme in the former Yugoslav Republic of Macedonia.

  • Serbia and Montenegro - Republic of Serbia
    Workshop on EU and GHS Criteria for Classification and Labelling of Chemicals
    In the framework of the wide assistance for issues related to chemicals, the Republic of Serbia requested the organisation of a Workshop on the Globally Harmonised System for Classification and Labelling of Chemicals (GHS) that took place in Belgrade on November 24-25 2006.

    The objectives of the workshop were to learn about GHS, to get an overview of the stage of the adoption of GHS by the European Union in order to facilitate the finalisation of the draft framework law on chemicals which will include also the GHS system.

    Chemicals activities in Serbia
    Under the first phase of the project a team of international consultants provided a review of the chemicals legislation in the Republic of Serbia and furnished recommendations on necessary legal drafting and amendments in order to introduce the EU chemical regulation system there.

    As a follow up to this assignment, the REC team assisted the ministry in drafting Serbia’s new framework chemicals law. The project supported the translation of selected EU chemicals legislation into Serbian. Also, REC consultants produced a gap analysis of the new draft law.

    A three-day visit to the University of Bremen was organised for the two members of the ministry working group team to discuss in detail the adaptation of the initial draft of the framework law to the circumstances and the administrative and legal set-up in the country with German legal experts.

    The first draft framework chemicals law was presented and discussed at a one-day workshop in Belgrade on April 22, 2005 with 70 stakeholders from ministries, agencies, academia, chemical industries and NGOs.

  • Serbia and Montenegro - Republic of Montenegro
    A similar chemicals assignment to the one implemented under Phase 1 of the project in the Republic of Serbia is being prepared for the Republic of Montenegro. In this way the project promotes the transfer of lessons learned from the work in Serbia, while also improving the chemical legal system and coping with legacies of the old legal system in the two constituent republics of Serbia and Montenegro.

    REC team of experts reviewed the draft law on chemicals and presented improvements and recommendations on a workshop that took place in Podgorica on December 16, 2006.

    Experts checked a draft law on air protection for consistency and compliance with relevant EU legislation and helped ministry representatives create a new draft through a table of concordance. The experts proposed concrete text amendments.

  • Kosovo (territory Under Interim UN Administration)
    A team of international experts drafted a law on noise protection which was reviewed at a stakeholder meeting held on October 24th, 2005 in Pristina and was sent for parliamentary approval and is in a procedure for adoption.

    The expert conducted a detailed review of development permitting procedures and identified gaps in domestic legislation by checking it against EU environmental impact assessment (EIA) requirements and drafting a table of concordance. The expert made recommendations for a full transposition of EU requirements and prepared a draft EIA law.
